Obama And the USSC

I am disturbed, but not surprised by some of the comments made by Barrack Obama as regards the role of a Justice of the Supreme Court and thereby, what we will get in the replacement for Justice David Souter, who is retiring, next month. Those comments give us a frightening view of what we have in store from anyone Obama might nominate.

 There are many, including the Washington Post… hardly a bastion of liberal thought… who have counseled Obama to look for judicial restraint:

 Alas, the once-dominant species of liberal proponents of judicial restraint has relatively few surviving members. Obama should find them – why not Jose Cabranes, the excellent judge whom President Clinton appointed to the 2nd Circuit? – and help revive the species. 

It appears that Obama will be moving in the opposite direction, making that restraint even more of a rarity. Comments made while  Obama was still just a candidate, as early as 2001, in an WBEZ interview,  are exemplary:

 But, the Supreme Court never ventured into the issues of redistribution of wealth, and of more basic issues such as political and economic justice in society. To that extent, as radical as I think people try to characterize the Warren Court, it wasn’t that radical. It didn’t break free from the essential constraints that were placed by the founding fathers in the Constitution, at least as its been interpreted and Warren Court interpreted in the same way, that generally the Constitution is a charter of negative liberties. Says what the states can’t do to you. Says what the Federal government can’t do to you, but doesn’t say what the Federal government or State government must do on your behalf, and that hasn’t shifted and one of the, I think, tragedies of the civil rights movement was, um, because the civil rights movement became so court focused I think there was a tendency to lose track of the political and community organizing and activities on the ground that are able to put together the actual coalition of powers through which you bring about redistributive change.

 Well, anyone who thinks the Warren court wasn’t radical, as Obama apparently does, has no sense of American history, first of all, and certainly no idea what the court is supposed to be doing.  It seems reasonably safe to assume that any nominee Obama comes up with now is going to be ‘restraint challenged’ the way a hungry Black Labrador puppy would be inside a 25 bag of Kibble.

 It is troublesome that Obama still pursues the socialistic goal of the redistribution of wealth. That is particularly troublesome in a recession, when demonstrably, forced wealth redistribution is counter productive to overall economic recovery.

 There are other markers of Obama’s train of thought that are equally disturbing, and are of a piece with his redistributionist efforts:

 “…we need somebody who’s got the heart, the empathy, to recognize what it’s like to be a young teenage mom. The empathy to understand what it’s like to be poor, or African-American, or gay, or disabled, or old. And that’s the criteria by which I’m going to be selecting my judges.”

 Notice, please, that Obama has said nothing whatever about the Constitution, here.  Isn’t upholding the Constitution as such the first duty of a jurist? For that matter, doesn’t the President swear also, to uphold the Constitution? Where then, in the Constitution is the redistribution of wealth stated as a power, or a responsibility of government?

 As Doctor Charles Krauthammer said the other night on the “Special Report” panel:

 But I thought what Obama said today was really remarkable when he said I want someone on the court who understands that justice isn’t about abstract legal theory. It’s about how our laws affect the daily realities of people’s lives.

 Now that is not only wrong, it’s deeply corrupting. The idea that you ought to be thinking about how the law affects the reality of someone’s life is something that you do when you are passing a law or create a law. That’s what you do if you are a member of Congress who represents people and their needs.

 But once the law is passed, the only job a judge has is to interpret the law without consideration of a person’s standing in life. Otherwise you could never have, say, a bank foreclosing on a home, because who, after all, is more affected, a bank that might lose a few dollars, or a family that’s going to lose its home and future livelihood, et cetera?

 The whole idea blinds a justice and the statutes that we have outside our courthouses of a blindfold over justice is that you do not look at a person’s station in life, their needs in life, requirements in life. It’s entirely about the law.

 Exactly so.

 What the Doctor misses, of course is the leftist view that the Surpeme Court is the legislature of last resort… and that the Warren Court only partially filled that role to Obama’s satisfaction speaks volumes to the problems freedom loving Americans now face.

 The bottom line here is that Obama can, and likely will, nominate someone so far out of the mainstream, that it will end up making Lani Guinier look like a reasonable choice.

 Consider, also, the emphasis Obama is placing on getting another woman on the court.  This is not an Guinier -like attempt to get particular Democrat sub-group represented.  The simple fact is that statistically, females live longer. Thereby, Obama is trying to extend the redistributionist hold on our government, further into the future, and nobody can stop him from doing so… and a far left-Senate seems unlikely to appreciably restrict him.

The one has decreed a new holiday”Cuatro de Cinco.”   Mary Katherine Ham, Weekly Standard, quips:

So, Obama, I will not turn your tendency to mispeak (and, then reprimand your Teleprompter) into an international incident, but I will note it with some glee:

This would have been the largest single  shipment of mayonnaise ever delivered to Mexico. But as we know, the great ship did not make it to New York. The ship hit an iceberg and sank, and the cargo was forever lost.

The people of Mexico, who were crazy about mayonnaise and were eagerly awaiting its delivery, were disconsolate at the loss. Their anguish was so great that they declared a National Day of Mourning, which they still observe to this day.

The National Day of Mourning occurs each year on May 5th and is known, of course, as Sinko De Mayo.

Thwarting Iran’s nuclear program is conditional on progress in peace negotiations between Israel and the “Palestinians”, according to White House Chief of Staff Rahm Emanuel.

First of all, what, short of the destruction of Israel has ever been satisfactory to the Palastinians, and in particular, Hamas?

Secondly, does Obama really propose letting the little bastard, Ahmadinejad, get nukes, based on Israel not being willing to commit suicide?

What we have here, freinds, is the definition of insanity, being displayed by the White House. Oh, hopey changitude.

Great, Rahm. What a guy you are for spelling this out. But before you do anything, would you please explain the word “progress”? When last we saw serious negotiations between Israelis and Palestinians (Bill Clinton and then Taba), the Palestinians, led by Arafat, walked out and began Intifada II. Would you have blamed Israel for that lack of “progress” and allowed Iran to get the bomb?

Then there is another hypothesis, why should Obama care about Israel, he lives in Chicago.  The one is pretty apathetic about those things, or peoples, in which he has no interest.

Well, Rick, given the treatment Reagan and his legacy are now getting at the hands of the supposed moderates, I would think the answer to be self-evident.

 Now, the Bush family, as I’ve been saying for years, is not conservative, but centrist, politically speaking. So, watch what comes out of his mouth the other day.. all in the name of the moderates:

So, according to Bush, we should become Democrats if we want to win. Funny thing; we just came off a loss, wherein the head of the ticket, John McCain was making the same noises.

See, the problem you’re missing, Rick, is that the moderates won’t tolerate Reagan.

But you know there’s an interesting meme that’s started coming up these last several days, and it’s actually alluded to by Bush, in the quote above.  The winning strategy of the Democrats.  What was that strategy? What did the Democrats do to win?

They went to their base, that’s what.  Every move the Republicans made was a reason for a press conference highlighted by leftists screaming and gnashing their teeth over whatever. For years, they cast Bush as the bad guy, the Republicans as the anti-American, and relentlessly pushed their core leftist values.  They weren’t accepting their moderates… they pushed them out. Consider Joe Lieberman, as a prime example.

So, not only is the issue that the moderates aren’t tolerating the conservatives, but the moderates have demonstrably pushed us into a losing strategy.

No, Rick, Sorry. Being “Democrat Lite” isn’t the answer. And the proof of that is sitting in the White House just now.

If Mario Armando Lavandeira b/k/a Perze Hilton was trying to stiffle free expression on the Internet and to put a halt to beiing used for sport, like the one’s promise to slow the raise of the oceans, Lavandeira has utterly failed.    Simon Owens, Bloggasm, examiness Lavandeira bogus copy right claims:

By the time YouTube removed an ad from the National Organization for Marriage (NOM) due to a DMCA takedown request, the video had already received thousands of views. The takedown notice had been sent to the video sharing site from representatives of Mario Armando Lavandeira – who blogs under the pseudonym Perez Hilton – and claimed that because the ad features about three seconds of footage from Perez’s video blog, it violates his copyright. Representatives also sent a cease and desist order on Friday to NOM demanding that the organization – well known for its opposition to legalizing gay marriage – stop playing the ad in television markets.

Lavandeira is ugly, mean, and stupid.   Sadly for Lavandeira, three seconds of video is more that ample time to demonnstrate all three points.

Say what you will about George (Forty-Three) Bush.  He had but two Supreme Court opening and he nailed both of them.   Both of Bush’s nominees John Roberts and Samuel Alito had impeccable  records and were conceded to judicial  intellects.

With the pending retirement of David Souter, the one now has his opportunity to leave his mark on the court.   Given that Souter is the very epitome of mediocre, Obama has a  great opportunity to upgrade the court and put a liberal intellect on the court to match the power of say Anton Scalia.  

Not surprisingly, Obama appears to be focusing demographics  and not judicial factors.    Obama isn’t looking for a liberal Scalia.   He looking for a spic chic.   Enter Sonia Sotomayor, from Jeffrey Rosen, New Republic:

But despite the praise from some of her former clerks, and warm words from some of her Second Circuit colleagues, there are also many reservations about Soto mayor. Over the past few weeks, I’ve been talking to a range of people who have worked with her, nearly all of them former law clerks for other judges on the Second Circuit or former federal prosecutors in New York. Most are Democrats and all of them want President ABM to appoint a judicial star of the highest intellectual caliber who has the potential to change the direction of the court. Nearly all of them acknowledged that Soto mayor is a presumptive front-runner, but nearly none of them raved about her. They expressed questions about her temperament, her judicial craftsmanship, and most of all, her ability to provide an intellectual counterweight to the conservative justices, as well as a clear liberal alternative

The case for Sotomayor is that she a compelling biography and mothering nature.   However as circuit court judge she seems rather mediocre.     The thought of Sotomayor doesn’t seem to be sending chills down the libtards’ spines.

Ed Morrissey, Hot Air, puts Sotomayor is context with all of Obama’s  appointments:

Considering Obama’s other appointments, though, this could be seen as a feature and not a bug. He hasn’t exactly made dazzling choices, from Tim Geithner to Tom Daschle to Bill Richardson to … well, Joe Biden is really the acid test here, since that choice reflects Obama’s judgment on who best represents his values and policies in case of a sudden emergency. If Sotomayor is the mediocrity that Rosen suggests, then remember that I predicted exactly that kind of appointment from the beginning, and bet accordingly.

Whatever Obama looks for in an appointee, it isn’t talent and ability.   Obama appears to limit his selections to only those few that fit his rather narrow socialist perspective.   While, Obama may consider himself, another John F. Kennedy, among other, Obama’s administration will never earn a Kennedy like description as the  Best and Brightest.    With the one, is more of the dull and the ideologue.

I think is one of the things politicians do to delude  themselves.   They tell that supporting their particular pet project is somehow beneficial for the nation as a whole.

One the vile thing about democrats in general,, and B.J. Clinton in particular, was their willingness to stand on still warm corpses to attempt to make political points.   The dust has not settled over Oklahoma City before Clinton blamed the bombing in talk radio.   The bodies were still warm in Columbine, when Clinton used the tragedy to campaign for yet more gun control.   Jack Kemp died on Saturday, and Specter using Kemp corpse has political soapbox.   The democrat Arlen Specter does a Clinton:  Specter  to  Bob Schieffer, as attributed by Tom LoBianco, Washington Times:

“If we had pursued what President Nixon declared in 1970 as the war on cancer, we would have cured many strains. I think Jack Kemp would be alive today. And that research has saved or prolonged many lives, including mine.”

I want a rebate on any of my tax dollars that were sued to save the worthless turd Specter.  When Teddy Kennedy dies of brain cancer, will Specter denounce democrat priorities on health care?

“Cured cancer”,  I just love Specter blind optimism that any problem can be solved if but we spend enough tax payer money.    Just like Specter’s fellow ‘rat, Lyndon Johnson’s “War on Poverty”  eradicated it.

Ok Amato is upset.   But note what either Amato did not post or Sebellius did not say.  No where in the interview is Sebelius quoting as saying she believes Joe Biden to be sane.  Not that I blame her.

I don’t see how Amato has the right to upset with Wallace’s quesation, when Sebelius will not answer the same quesation.    So question for you John, do you believe that Biden is sane?

Last night on FoxNews’s O’Reilly Factor with Laura Ingraham substituting for the show’s eponymous host, feminist Gloria Feldt said Miss California, Carrie Prejean, needed a “heart transplant.” So, since that young woman has offered a position on gay marriage nearly identical to that of the President of the United States, does this feminist believe that Barack Obama needs a “heart transplant” as well?
