  • ELENA KAGEN: Nobody should be surprised at the Obama White House nominating the current Solicitor General Elena Kagan  to the  next U.S. Supreme Court seat.  At every turn, the Obama and his staff have revealed their radical leftist roots.  Why should this be any different?  Kagan if it’s the far left like a glove.  Her hostility to the military has become the stuff of legend, until such time as the left found that they had to defend it, and they now downplay it. The group politics involved with the radical left is perhaps best exemplified by Saint Andrew the Incontinent’s recent post: “So, is she Gay?”  It hardly matters to me, but apparently Saint Andrew still judges all things by his own narrow worldview. I’m not the only one who has noticed, either. I suggest looking a little deeper though.  All the various subgroups involved with the left these days are showing their own double standards.  Roland Martin, yesterday points at one such:

    — If a white Republican president of the United States appointed a white male as his next Supreme Court justice, and upon the inspection of his record, it was discovered that of the 29 full-time tenured or tenured track faculty he hired as dean of Harvard Law, nearly all of them were white men, this would dominate the headlines.

    It would be reasonable to conclude that the special interest groups that vigorously fight for diversity — civil rights organizations, feminist groups and other liberal institutions — would be up in arms, declaring that this person’s records showed him unwilling to diversify academia, and unqualified to consider diverse views as one of nine members of the U.S. Supreme Court. There would be widespread condemnations of Republicans having no concern for the nonwhite males in America.

    But what if the choice were made by a black Democratic president, and it was a woman? A white woman? A white Democratic woman?

    Some of you may not like the fact that I am focusing on the race of the individual, but when diversity is raised, the person’s skin color, gender and background are considered germane to the discussion. And if there is silence from black and female organizations, their race and gender matter as well.

    That does seem a reasonable point.  That said, reasonable points seem to get ignored when the radical left is in charge. Ann Althouse raises another:

    Elena Kagan said “There is no federal constitutional right to same-sex marriage,” but does that mean that, as a Supreme Court Justice, she won’t find that right?

    Stay tuned.  I have no doubt that she will.

  • DCCC PULLS OUT OF HI: Reid Wilson of Hotline reports:

    The DCCC is pulling out of the race to replace ex-Rep. Neil Abercrombie (D-HI), effectively ceding the heavily Dem seat to the GOP as intra-party feuding splits the vote.  — “The DCCC will not be investing additional resources in the HI-01 (Abercrombie-open) special election.

    To me, this speaks volumes to how much trouble the Democrats perceive themselves in, in the next few cycles.

In a word, this is preposterous – a function of liberal cowardice and conservative discomfort. It should mean nothing either way. Since the issue of this tiny minority – and the right of the huge majority to determine its rights and equality – is a live issue for the court in the next generation, and since it would be bizarre to argue that a Justice’s sexual orientation will not in some way affect his or her judgment of the issue, it is only logical that this question should be clarified

It is not a matter of clarification.  Kagan’s sexual preference is not a secret. from R.S.  McCain:

This is an actual letter sent to a man named Ryan DeVries regarding a pond on his property. It was sent by the Pennsylvania Department of Environmental Quality, State of Pennsylvania . This guy ‘ s response is hilarious, but read State ‘ s letter before you get to the response letter.

SUBJECT: DEQ File No.97-59-0023; T11N; R10W, Sec. 20; Lycoming County

Dear Mr. DeVries:

It has come to the attention of the Department of Environmental Quality that there has been recent unauthorized activity on the above referenced parcel of property..  You have been certified as the legal landowner and/or contractor who did the following unauthorized activity:

Construction and maintenance of two wood debris dams across the outlet stream of Spring Pond.

A permit must be issued prior to the start of this type of activity. A review of the Department ‘ s files shows that no permits have been issued.  Therefore, the Department has determined that this activity is in violation of Part 301, Inland Lakes and Streams, of the Natural Resource and Environmental Protection Act, Act 451 of the Public Acts of 1994, being sections 324.30101 to 324.30113 of the Pennsylvania Compiled Laws, annotated.

The Department has been informed that one or both of the dams partially failed during a recent rain event, causing debris and flooding at downstream locations.  We find that dams of this nature are inherently hazardous and cannot be permitted. The Department therefore orders you to cease and desist all activities at this location, and to restore the stream to a free-flow condition by removing all wood and brush forming the dams from the stream channel.  All restoration work shall be completed no later than January 31, 2010.

Please notify this office when the restoration has been completed so that a follow-up site inspection may be scheduled by our staff.  Failure to comply with this request or any further unauthorized activity on the site may result in this case being referred for elevated enforcement action.  We anticipate and would appreciate your full cooperation in this matter.  Please feel free to contact me at this office if you have any questions.

Dear Mr. Price,

Your certified letter dated 08/17/09 has been handed to me to respond to.  I am the legal landowner but not the Contractor at 2088 Dagget Lane , Trout Run, Pennsylvania .

A couple of beavers are in the (State unauthorized) process of constructing and maintaining two wood “debris” dams across the outlet stream of my Spring Pond.  While I did not pay for, authorize, nor supervise their dam project, I think they would be highly offended that you call their skillful use of natures building materials “debris.”

I would like to challenge your department to attempt to emulate their dam project any time and/or any place you choose. I believe I can safely state there is no way you could ever match their dam skills, their dam resourcefulness, their dam ingenuity, their dam persistence, their dam determination and/or their dam work ethic..

These are the beavers/contractors you are seeking. As to your request, I do not think the beavers are aware that they must first fill out a dam permit prior to the start of this type of dam activity.

My first dam question to you is:

(1) Are you trying to discriminate against my Spring Pond Beavers, or

(2) do you require all beavers throughout this State to conform to said dam request?

If you are not discriminating against these particular beavers, through the Freedom of Information Act, I request completed copies of all those other applicable beaver dam permits that have been issued.

(Perhaps we will see if there really is a dam violation of Part 301, Inland Lakes and Streams, of the Natural Resource and Environmental Protection Act, Act 451 of the Public Acts of 1994, being sections 324.30101 to 324.30113 of the Pennsylvania Compiled Laws, annotated.)

I have several concerns.  My first concern is, aren’t the beavers entitled to legal representation?  The Spring Pond Beavers are financially destitute and are unable to pay for said representation — so the State will have to provide them with a dam lawyer.  The Department ‘ s dam concern that either one or both of the dams failed during a recent rain event, causing flooding, is proof that this is a natural occurrence, which the Department is required to protect.  In other words, we should leave the Spring Pond Beavers alone rather than harassing them and calling them dam names.

If you want the stream “restored” to a dam free-flow condition please contact the beavers — but if you are going to arrest them, they obviously did not pay any attention to your dam letter, they being unable to read English.

In my humble opinion, the Spring Pond Beavers have a right to build their unauthorized dams as long as the sky is blue, the grass is green and water flows downstream.  They have more dam rights than I do to live and enjoy Spring Pond.  If the Department of Natural Resources and Environmental Protection lives up to its name, it should protect the natural resources (Beavers) and the environment (Beavers ‘ Dams).

So, as far as the beavers and I are concerned, this dam case can be referred for more elevated enforcement action right now. Why wait until 1/31/2010? The Spring Pond Beavers may be under the dam ice then and there will be no way for you or your dam staff to contact/harass them.

In conclusion, I would like to bring to your attention to a real environmental quality, health, problem in the area..  It is the bears! Bears are actually defecating in our woods.  I definitely believe you should be persecuting the defecating bears and leave the beavers alone. If you are going to investigate the beaver dam, watch your step! The bears are not careful where they dump!

Being unable to comply with your dam request, and being unable to contact you on your dam answering machine, I am sending this response to your dam office.

  • IDIOT SHEEP? Yes, I think Roger Simon’s got this one down… Identity Politics is for idiot sheep and the LA Unified School District. Idiot sheep, huh? Yeah that accounts for the vast majority of the Democrat voter base. On a deeper level, though the vid Roger shows us gives us a clue as to what we’re up against.  Trouble is our ‘leaders’ won’t see it.  Oh, and shall we point out the jery involved is a good union member and is filling young heads full of his mush?
  • PAKISTANI TALIBAN INVOLVED IN NYC BOMB ATTEMPT? Well, the White House is now quietly admitting what we already knew… Faisal Shahzad was not acting alone. All this would seem to give a lot more weight to the argument that the suspect should not have been given Miranda Rights. Holder seems to be responding to the pressure on that point. Leaders often take unilateral action as opposed to waiting for a legal ruling.  Holder is apparently looking for political cover here, and is looking for a legal ruling. So we remain in danger while are so called leaders seek legal cover.  Such is what happens when we place far too much dependence on law and government.
  • THE ARIZONA IMMIGRATION LAW: I made mention a few days ago about the immigration law in Arizona and how Pennsylvania’s state legislature was considering a similar motion .  Keeping in mind that Pennsylvania is not noted for being the most conservative state and union, this struck me as nothing short of Earth shaking .  Now we see a poll from Scott Rasmussen which suggest that some 55% of Colorado state voters are in favor of the immigration law as laid out by Arizona.  It strikes me that whoever is controlling the narrative that we see in the mainstream press these days on the immigration law, there is a weakness being exposed in terms of their ability to actually alter public opinion in their favor.  Two of the more liberal states in our union highly approve of Arizona’s act of self protection .  Perhaps even more importantly, Rasmussen also reports that on a national basis 60% of voters approve of Arizona’s measures .  And this to me is revealing in the extreme.   It strikes me that the leftist government isn’t the only thing that’s mistrusted here, but also its official propagandists in the supposedly mainstream media.  What we have here is not Democrat versus Republican, but big government versus small government.  Incumbents from both parties who have been part of giving big government more power yet, are being targeted, and are disappearing.  I see that as a good thing.It does seem to answer the question whether not the idea of smaller government will actually catch on.
  • BENNET OUT in UTAH: That mistrust, of course, is going largely to incumbents, and it is interesting and revealing to note that the messages being sent to comments from both parties in equal  measure.  Example: There seems no doubt that Bob Bennett was unseated by the tea party.  In all fairness, I tend to think that he was not the leftie hack that some made him out to be.  Still, there was clearly a disconnect between him and the voters, particularly as regards TARP and related matters.  Bennett for whatever good he brought to the seat , also enabled big government.  Such is the nature of centrists.  They will play with the leftists to get along with them, thus furthering the cause of big government.  It’s precisely why I argued against a lot of the policies of 41 and 43.  The message , is clear and concise.  Advocate smaller government, and work toward smaller government, and you will have the support of the voters.  Do otherwise, including trying to compromise with the evil of larger government, and you’ll be removed.  Regardless of what party you happen to claim membership in.
  • NASHVILLE & OTHER WHITE HOUSE DISASTERS: David made mention last week of Nashville, as did Bruce, who he linked. The floods down there are, while not quite of Biblical proportions, certainly worth a Federal response.  But for all the media that surrounds Nashville, the funny part of it all is we didn’t hear very much about it.  And certainly the Federal government didn’t do very much about it.  So what we have here, is Katrina with steel guitars. Other disasters of similar scope would seem  to me  to include the oil spill in the gulf, the federal response to which has been at best laughable, and typical…. the lawyers get called out be hardly anyone that can actually solve the problem.  The Times Square attack, where apparently far more White House effort went into controlling the narrative, (However unsuccessfully)  and ‘protecting the supposed rights of terrorists, than actually finding out who was behind it and dealing with the source of the attack in anything approaching an appropriate manner. Then there’s the rising unemployment levels which the White House has been trying to spin as a good thing. It strikes me that there’s a level White House incompetency  here that is being revealed…. not only are the voters in this country beginning to take notice, but make no mistake…. our enemies are noticing too.
  • FREE SPEECH NOW ISN’T: When flag burning was done in support of leftists, and their ideas and ideals, it was free speech. With leftists in power, not so much. By their actions, ye shall know them, folks.

In his first Sunday morning interview, Attorney General Eric Holder revealed that the Pakistani Taliban was behind Faisal Shahzad’s attempted bombing of Times Square last week.

“We’ve now developed evidence that shows that the Pakistani Taliban was behind the attack,” Holder said on “This Week.”

“We know that they helped facilitate it. We know that they probably helped finance it. And that he was working at their direction.”

So if Eric Holder, not exactly the brightest bulb in the drawer, can figure out that Faisal Shahzad’s had foreign help why was Department of Homeland Security secretary Janet Napolitano so darn quick to declare  Shahzad’s s lone wolf?    Has Napolitano delegated national intelligence to the Justice Department?

More, Jim Hoft, Gateway Pundit:

Earlier this week it was reported that the Obama White House removed confessed terrorist Faisal Shahzad from the Department of Homeland Security travel lookout list sometime after Barack Obama came into office.

Terrorist Faisal Shahzad had substantial connections to the Taliban, reached out to the Taliban, was influenced by Yemeni terror leader Anwar al Awlaki, made at least a dozen return trips to Pakistan since arriving in the United States in 1999, and he bought a one way ticket with cash to Pakistan.

Still more, Tim Cavanaugh, Reason, suggests that Napolitano will continue to her wrong headed focus until prople actually die:

Napolitano’s rhetorical slip is a little too serious to be palmed off with some linguistic woolgathering. She has made clear repeatedly that she believes people with Gadsden flag bumper stickers are a greater threat to domestic tranquility than out-of-the-closet terrorists who receive training and material assistance in foreign terror centers. She has been wrong about this every time, and she will continue to be wrong until Americans actually die.

You would think the mission of DHS is to protect the American people.   With Napolitano as the helm of DHD, you would be wrong.

Cape Wind, which wants to build 130 wind turbines off the coast of Cape Cod, and National Grid announced yesterday that they’ve reached an agreement to start charging customers 20.7 cents per kilowatt hour in 2013 – more than double the current rate of electricity from conventional power plants and land-based wind farms.

It seems the late Senator Oldsmobile was right to oppose this boondagle albeit for the wrong reasons.   Like the poor Bay State saps have nothing better to do with their hard earned money they pay double price for electric power.   The wind may be free, but wind power sure is not.

Prof. Michael Lynn, marketing and tourism, surveyed 374 waitresses about their perceived “sexiness,” breast size and other physical characteristics and correlated these results with the amount of tips the waitresses received.

His results indicate that evolutionary instinct trumps the ideals many patrons profess. Though most customers say they reward service, Lynn reports that quality of service has less than a 2-percent effect on the actual tip.

I will not argue the results of the study, to wit a positive correlation between breast size and amount of tips.   While I for from an expert on breataraunds, ala Hooters, I have spent considerable time in Greek restaurants, a/k/a the American style diner.  I suspect that a restaurant owner who hired by breast size would soon go broke.   Failure is the norm in the restaurant business.

While sexual attractiveness is certainly a factor for a server, more important is the ability to multitask,  and to keep keep your wits and humor in stressful situations.  I contend that you tell if person is cut out to be server after one shift.   Some people can juggle many individually simple task,    While other can not.   Waitressing  is not rocket science, but is good career for those who can do it well.

As the parent of autistic kids, I think I’ve earned the right to ask what the blink IS causing it, then?

As  free Americans,. we all have rights to ask questions.    As children of God we can seek answers.   However God has no obligation to provide them.

Ask a renowned skeptic,  I have long felt that trial lawyers make lousy scientists.    I have argued gun control long enough to know that correlation is not causation.   Easy answers, like mercury in vaccines might be good for convincing juries, but they do not necessarily lead to the truth.  Then trial lawyers don’t want to cure autism, or find its cause, they want their contingency fees.

God and Man. It important to know that God does and what Man does.   These moron, well Obamatards have clearly conflated God and Man, video:

While health may be a gift from God, health care is a commodity provided by human endeavor.   There can be no right to health care.  For in order for health care to be given to one person, it first must be taken away from another.   God does not create health care, men do, and in a free country free men provide their services only of their free will.    These Obamatards may pray to Obama as if he were their god.   However Obama is but a mere mortal.   He only has power to take health care away, but not to create health care where none exists.

Sex Change stupidity, this this time from the Brits, Daily Mail (UK):

Cher’s offspring Chaz Bono is officially a man after he changed his name and gender in court yesterday.

Bono, who was born a girl named Chastity, is now legally recognised as a male, a year after undergoing a sex change.

The 41-year-old, whose father was the late singer and politician Sonny Bono, beamed with happiness as he left Santa Monica courthouse.

Memo to our friends across the pond, Chaz changed her name.  She did not change her sex.  Sex is immutable.   Chaz was born a female and she will die a female.  That just the way it is.

  • THE ESTABLISHMENT STRIKES BACK: I see the Washington Examiner making reference to an article over at The Politico :

    Politico’s Mike Allen and Kenneth Vogel have an interesting story today on an effort that has been in the works for about a year in which an all-star list of Establishment Republican operatives are seeking to duplicate what the Democrats did in the past decade in order to regain congressional majorities and put somebody in the White House.

    “The network, which doesn’t have a name, attempts to replicate the Democracy Alliance, an umbrella group — founded in 2005 and funded by George Soros and other billionaires — and to borrow tactics from liberal groups established to help Democrats regain power after eight years of the Bush administration.

    “Two organizers of the Republican groups even made pilgrimages earlier this year to pick the brain of John Podesta, the former Clinton White House chief of staff who, in 2003, founded the Center for American Progress and was a major proponent of Democrats developing the kind of infrastructure pioneered by Republicans.”

    What they fail, apparently, to understand here is that the reason the GOP got voted out is because the issues and concerns being brought to the fore by the tea party folks were being ignored. So instead of getting behind the tea party movement, it appears that the establishment GOP… that part of the party which was flatly rejected by conservatives, will continue to march in its own direction, and completely ignore the tea party ears, which in my view are the core voter of the Republican party.  And yes, I would include democrats in that statement who vote republican.  More or less, Reaganites.

    “The operating assumption of Rove, Gillespie and the other organizers is that despite the historical dominance of Republican fund-raising and organizing, the GOP has been outmaneuvered by Democrats and their allies in recent years, and it is time to strike back.

    The assumption being made here is spectacularly, earthshakingly stupid, on a level I can’t get my arms around. These people really believe that Democrats who out- maneuvered Republicans on the political stage were the reason the GOP lost… and that it has nothing whatsoever to do with the concerns being raised by the tea party? Amazing.   I suspect what we’re going to see offered by the GOP is simply more of the same lukewarm liberalism , and if that’s the case you can forget about taking over Congress and the White House again in any large plurality. The American voter simply isn’t going to buy it. Dan Riehl seems to be on the same page:

    Now, thanks to Rove and Gillespie, what’s more likely to happen is a well funded, top down establishment and consultant driven effort very likely to find itself in strong opposition to the Right-side grassroots that has been out here doing the hard work for years.

    Just plain stupid. Frankly, I would’ve expected Karl Rove. The man’s good at what he does, but I wonder if his calculations on this matter don’t suffer from a lack of the ability to perceive what our conservative principles versus what are conservative politicking.

DavidL's Breakfast ScrambleLawrence Taylor charged with statutory rape, from Jammie Wearing Fool, and Ace

Football Hall of Famer Lawrence Taylor was arrested in a Rockland hotel overnight and charged with raping a 15-year-old girl, police said.

The 51-year-old former linebacker for the New York Giants was taken into custody by Ramapo police. He was being held in the town jail with an arraignment in Town Court scheduled for this afternoon.

He was charged with third-degree rape, a charge that involves having intercourse with a minor. The victim was reportedly beaten during the attack

Needless to say, Taylor is presumed innocent until proven guilty.   However will Obama wait for Taylor’s conviction before appointing him to the cabinet?

California school punishes patriotism, from Zombie, Pajamas Media:

Five students at a South Bay high school stirred up some controversy Wednesday for wearing t-shirts depicting red, white and blue American flags on Cinco de Mayo.

School officials at Live Oak High in Morgan Hill told the students they had to go home if they wouldn’t turn the shirts inside out.

One of the students said it appeared school administrators were worried the patriotic shirts could trigger fights.

Some students at Live Oak High in Morgan Hill said others were planning to come to school Thursday wearing red, white and blue

Keep the students in school.  Send the principle, and the wetbacks, home.

:If Mr. Obama is serious about his commitment to courtesy and respect, then he will need to demonstrate presidential leadership and rein in the verbal excesses of the leaders of his own party. He could start by having a conversation with Speaker Nancy Pelosi, who condemned those with different views on health care as being “un-American.” He might also share a word with Senate Majority Leader Harry Reid, who recently accused Republicans of being “anti-American” and wanting to continue to “make love to Wall Street” by pressing for changes in a bill regulating the financial industry.

You have to give away what you want to receive.  If person, even a president, wants reppect, he has give respect.   A major problem for Dm Won, a/k/a President of the United States Barack Obama, that he shows respect to one.    Dim Won demands respect, but give none.   No wonder he gets none.   It ain’t rocket science, but Obama is no rocket scientist.
